1. Acceptance of terms

These Terms of Use ("Terms") govern your access to and use of engineseven.com (the "Site"), operated by Engine Seven ("Engine Seven," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Use of the Site

You may use the Site for lawful, informational purposes only. You agree not to:

  • Use the Site in any way that violates applicable law or regulation;
  • Attempt to gain unauthorized access to the Site, its servers, or related systems;
  • Interfere with or disrupt the integrity or performance of the Site;
  • Introduce malware or any other harmful code; or
  • Reproduce, scrape, or exploit the Site or its content for commercial purposes without our prior written consent.

The Site and its contents — including text, graphics, logos, the "Engine Seven" name and mark, layout, and design — are owned by or licensed to Engine Seven and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from any part of the Site without our prior written permission. You may view and print pages for your own personal, non-commercial reference.

4. No professional advice

Content on the Site is provided for general informational purposes only and does not constitute strategic, operational, financial, legal, or other professional advice. Nothing on the Site creates a consulting relationship, and you should not act or refrain from acting based on Site content alone. Any consulting engagement with Engine Seven is governed by a separate written agreement, which will take precedence over these Terms with respect to that engagement.

The Site may contain links to third-party websites or resources. We provide these links for convenience only and do not endorse or assume responsibility for the content, products, or practices of any third party. Accessing third-party sites is at your own risk and subject to their terms and policies.

6. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Engine Seven disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on it is accurate, complete, or current.

7. Limitation of liability

To the fullest extent permitted by law, Engine Seven and its principals, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, business, or goodwill, arising out of or related to your use of — or inability to use — the Site, even if advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.

8. Indemnification

You agree to indemnify and hold harmless Engine Seven and its principals, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Site or your breach of these Terms.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and handle personal information. By using the Site, you consent to the practices described there.

10. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia for the resolution of any dispute arising out of or relating to these Terms or the Site.

11. Changes to these terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Changes are effective when posted, and your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

12. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy and any applicable engagement agreement, constitute the entire agreement between you and Engine Seven regarding the Site.
